De fet, una sent\u00e8ncia recent recorda que si no es torna formalment la possessi\u00f3 al propietari \u2014especialment mitjan\u00e7ant el lliurament adequat de les claus\u2014 el contracte pot continuar vigent, amb la conseg\u00fcent obligaci\u00f3 de pagar la renda.<\/p>\n\n<p>Un dels errors m\u00e9s comuns \u00e9s pensar que nom\u00e9s cal sortir del pis i comunicar-ho. No obstant, la llei exigeix una mica m\u00e9s: un lliurament formal de les claus, en les condicions acordades al contracte. Generalment, aix\u00f2 implica coordinar una cita amb l&#8217;arrendador o el seu representant i signar un document que certifiqui el lliurament. Deixar les claus amb un tercer o conservar-ne una c\u00f2pia fins a rebre la fian\u00e7a no compleix aquest requisit.<\/p>\n\n<p>A m\u00e9s, condicionar la devoluci\u00f3 de claus al pagament de la fian\u00e7a es pot tornar en contra de l&#8217;inquil\u00ed. La normativa disposa que la devoluci\u00f3 econ\u00f2mica nom\u00e9s es podr\u00e0 fer un cop s&#8217;hagi lliurat l&#8217;immoble. Si l&#8217;arrendador no rep les claus correctament, el contracte no es considera extingit i pot exigir el pagament de rendes.<\/p>\n\n<p>La manera m\u00e9s segura d&#8217;evitar conflictes \u00e9s coordinar un lliurament presencial, signar una acta de recepci\u00f3 i conservar-ne c\u00f2pia. Si aix\u00f2 no \u00e9s possible, un notari o fins i tot el jutjat poden servir com a via per acreditar que l&#8217;inquil\u00ed ha complert la seva obligaci\u00f3 de tornar la possessi\u00f3 de l&#8217;immoble.<\/p>\n\n<p>A <strong>Qualia H\u00e0bitat<\/strong> recomanem prestar especial atenci\u00f3 a aquest pas final. No \u00e9s una mera formalitat, sin\u00f3 un acte jur\u00eddic que marca el veritable tancament del contracte.
