Un exemple clar \u00e9s la col\u00b7locaci\u00f3 de cartells, com els que adverteixen sobre c\u00e0meres de seguretat o anuncis publicitaris a la fa\u00e7ana. Per\u00f2, quins drets tenen els propietaris per oposar-se a aquests anuncis?<\/p>\n\n<p class=\"wp-block-paragraph\">Primer, \u00e9s important entendre que la fa\u00e7ana i els passadissos s\u00f3n elements comuns de l&#8217;edifici, per la qual cosa un cartell instal\u00b7lat no est\u00e0 en propietat exclusiva de ning\u00fa. En el cas de cartells que informen sobre videovigil\u00e0ncia, s\u00f3n obligatoris segons el Reglament General de Protecci\u00f3 de Dades (RGPD) i s&#8217;han de col\u00b7locar a llocs visibles abans d&#8217;entrar a la zona gravada. Ni la comunitat ni un propietari no es poden negar a la seva instal\u00b7laci\u00f3.<br\/><br\/><br\/><br\/><\/p>\n\n<p class=\"wp-block-paragraph\">Tot i aix\u00f2, quan parlem d&#8217;anuncis publicitaris, la situaci\u00f3 canvia. Segons l&#8217;article 396 del Codi Civil, la fa\u00e7ana \u00e9s un element com\u00fa, per la qual cosa per col\u00b7locar un cartell que anunci\u00ef un negoci o activitat comercial cal el consentiment de la Junta de Propietaris.<\/p>\n\n<p class=\"wp-block-paragraph\">Hi ha excepcions, per exemple:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Si els estatuts de la comunitat ho autoritzen, \u00e9s possible instal\u00b7lar cartells en certs espais, com els locals comercials, ja que la jurisprud\u00e8ncia sol ser flexible en aquests casos i admet la seva col\u00b7locaci\u00f3.<\/li>\n\n\n\n<li>Si la comunitat ha autoritzat expressament o de manera t\u00e0cita la col\u00b7locaci\u00f3.<\/li>\n\n\n\n<li>Si el cartell no altera significativament l&#8217;est\u00e8tica o l&#8217;estructura de l&#8217;edifici.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">En cas de desacord, un propietari pot impugnar l\u2019acord comunitari que hagi autoritzat el cartell. A m\u00e9s, si un cartell afecta negativament el dret de llums o de vistes, podria ser retirat per il\u00b7legal.<\/p>\n\n<p class=\"wp-block-paragraph\">La jurisprud\u00e8ncia \u00e9s clara: diversos tribunals han declarat il\u00b7legal la col\u00b7locaci\u00f3 de cartells a fa\u00e7anes sense autoritzaci\u00f3, i n&#8217;han ordenat la retirada quan afecten la conviv\u00e8ncia o l&#8217;\u00fas dels espais comuns.<\/p>\n\n<p class=\"wp-block-paragraph\">A <strong>Qualia Habitat<\/strong> entenem que l&#8217;harmonia a la comunitat \u00e9s essencial i assessorem propietaris per protegir els seus drets davant d&#8217;aquestes situacions.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A les comunitats de propietaris, el que beneficia els uns pot afectar negativament els altres.
